Insurers refuse a large share of claims by pointing to an exclusion or saying the treatment isn't covered. But an exclusion has to be explicitly stated and clearly disclosed, and where the wording is ambiguous it is construed against the insurer that drafted it — so an exclusion that is vague, or stretched beyond its real scope, can be disputed.
Why insurers reject on this ground
The insurer says the ailment, treatment, or expense falls under a policy exclusion, or is simply outside the scope of cover — the largest chunk of “not covered” rejections.
When you can challenge it
Exclusions are read narrowly. If the clause is ambiguous, the contra proferentem principle construes it against the insurer that wrote it. IRDAI has also standardised many exclusions, so an insurer cannot apply one more broadly than its defined wording, apply an exclusion that was never clearly disclosed, or treat a covered treatment as excluded. Whether the exclusion truly fits your treatment is a question of fact you can contest.
How to fight this rejection
Get the exact exclusion clause quoted
Obtain the rejection letter with the specific exclusion, and read it against the full policy wording to see precisely what it covers.
Test whether the exclusion really applies
Compare your treatment, diagnosis, and the doctor's notes to the words of the exclusion — note any ambiguity, or any way the exclusion is being stretched.
Point to standard/clear-wording requirements
In your grievance, argue any ambiguity should be read against the insurer, and that the exclusion cannot be applied beyond its defined scope or if it was not clearly disclosed.
Raise a written grievance with the insurer's GRO
Send a dated grievance to the insurer's Grievance Redressal Officer setting out why the rejection is wrong. The insurer must acknowledge it immediately and resolve it within 14 days.
Escalate to IRDAI on Bima Bharosa
If it isn't resolved in time or the reply is unsatisfactory, register the complaint on IRDAI's Bima Bharosa portal.
Take it to the Insurance Ombudsman
Free, binding on the insurer, and open to claims up to ₹50 lakh — file within one year of the insurer's rejection or final reply.
