Motor Claim Dispute? You Are Not Out of Options.
Total loss undervaluation, repair cost cuts, third-party delays — what each dispute needs, and where it goes.
If the insurer assesses your vehicle as unrepairable — a wreck, a 'total loss' or 'write-off' — IRDAI's Master Circular on General Insurance Business requires it to give you the option of keeping the wreck and accepting a 'cash loss' settlement: the IDV less the assessed value of the salvage. If you take it, the insurer may cancel your own-damage cover from the date of damage, and may cancel your third-party cover unless you cancel the wreck's registration or insure the wreck for third-party risk.
In a repair-cost dispute, the surveyor may have disallowed parts and labour the policy covers. The fix is to get an independent surveyor's report and challenge each disallowance with photographs and invoices.
Third-party MACT claims require a different playbook. The compensation amount depends on income proof, age, dependents, and disability percentage.
For an own-damage dispute, BimaHaq's free letter templates cover the grievance to the insurer, and BimaHaq can prepare the Bima Bharosa complaint and the Ombudsman file, explaining each step in plain English; you submit each one in your own name. BimaHaq does not take part in MACT proceedings.
